Giving property to children or other family members during life can feel like an easy way to simplify an estate. Sometimes a gift fits the larger plan. Sometimes it creates tax, creditor, ownership, or family problems that are difficult to reverse.

A gift means giving up control

An outright gift generally belongs to the recipient. The property may become exposed to that person’s creditors, divorce, poor decisions, or unexpected death. Adding someone to a deed or account is not merely a convenience; it can create real ownership rights.

Tax rules are more complicated than the annual exclusion

The federal annual gift-tax exclusion is only one part of the analysis. A gift larger than the exclusion does not automatically mean tax is immediately due, but reporting may be required and lifetime gifts interact with the federal estate-and-gift-tax system. Income-tax basis can also affect the recipient’s future capital gain.

Real estate brings additional questions

A transfer of California real estate may affect property taxes, insurance, financing, creditor exposure, and future sale consequences. Never rely on a simple deed change without reviewing the legal and tax effects.

Public-benefit eligibility may be affected

A gift to a beneficiary who receives means-tested benefits can disrupt eligibility. A transfer by the donor may also matter when the donor later seeks certain benefits. Specialized advice may be needed before acting.

Start with the goal, not the transfer

If the goal is probate avoidance, help with bills, gradual inheritance, or protection for a family member, another estate-planning tool may address it with fewer unintended consequences. Gene Gleason can help identify the legal questions, with tax advice coordinated when needed.
